FMC Approves Confidential Philip Reinisch-Flexport Settlement

The Federal Maritime Commission on March 24 approved a confidential settlement agreement to resolve a detention and demurrage dispute between Philip Reinisch Co. and Flexport International. The "proceeding would require potentially expensive discovery and briefing," the FMC said, and both parties "determined that the settlement reasonably resolves the issues raised in the complaint without the need for costly and uncertain litigation."

The dispute began when Philip Reinisch accused Flexport in September of failing to include required information on more than $100,000 of detention and demurrage charges and asked the FMC to order Flexport to refund over $55,000 and nullify nearly $50,000 in outstanding charges (see 2210040021). Flexport denied those claims, saying its conduct was "reasonable in light of the totality of the circumstances” (see 2211180011).
