The Commerce Department published the amended final results of the antidumping duty administrative review on steel nails from Malaysia (A-557-816), to correct ministerial errors in the calculation of the rates for entries of subject merchandise during the period July 1, 2020, through June 30, 2021.

Export Compliance Daily combines U.S. export control news, foreign border import regulation and policy developments into a single daily information service that reliably informs its trade professional readers about important current issues affecting their operations.
The original final results were effective Feb. 8. After the final results were published, comments on them led Commerce to conclude it made errors, and the agency is now making changes to the calculation of the weighted-average dumping margin for Region, Inmax, and for the non-selected respondents. The result is that the AD rate for Inmax fell to zero percent, and the rate calculated for Region and non-selected respondents increased from the 1.21% and 1.26% rates, respectively, determined in the original final results.
The new rates are effective March 14, the date of publication in the Federal Register.
These amended final results will be used to set final assessments of AD duties on importers for subject merchandise entered July 1, 2020, through June 30, 2021.
For exporters of subject merchandise that were not under review (i.e., all except the companies listed below), cash deposit rates remain at the level set in the most recent review of each respective company. If the exporter has never been assigned its own AD rate but the manufacturer has, the rate assigned to the manufacturer applies. For merchandise manufactured and exported by companies that have never been assigned a cash deposit rate by Commerce, the all-others rate of 2.66% applies.
New Cash Deposit Rates Take Effect March 14
For entries on or after March 14, Commerce is setting new AD cash deposit rates for subject merchandise produced or exported by the companies listed below, as follows:
| Exporter | AD Rate |
|---|---|
| Region International Co. Ltd./Region System Sdn. Bhd. | 1.66% |
| Inmax Sdn. Bhd./Inmax Industries Sdn. Bhd. | zero |
| Non-Individually examined companies* | 1.66% |
* See Appendix I of the notice for the list of non-individually examined companies.
Assessment Rates
As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between July 1, 2020, and June 30, 2021. Commerce will direct CBP to liquidate entries during that period from Region at importer-specific rates, and entries from Inmax will be liquidated without regard to antidumping duties. Entries from the other importers subject to this review will be liquidated at the rates listed above.
(The review period is 07/01/20 - 06/30/21. See Commerce's notice for more information, including the scope of the order, detailed cash deposit and assessment instructions, etc. See 2302070007 for the original final results of this review, and 2208040062 for a summary of the preliminary results.)
