Preserved Mushrooms: Details of AD Order for France

The Commerce Department on Jan. 19 published an antidumping duty order on preserved mushrooms from France (A-427-833). The order sets permanent antidumping duties, which will remain in place unless revoked by Commerce in a sunset or changed circumstances review. Commerce will now begin conducting annual administrative reviews, if requested, to determine final assessments of antidumping duties on importers and make changes to cash deposit rates.

The order details a seven-day gap period of no AD duty liability for subject merchandise entered Jan. 11-17, 2023. Commerce may only suspend liquidation for four months after its preliminary AD duty determination (extendable to six months, but not extended in this case), issued Sept. 13 without the International Trade Commission having found injury. Commerce will order CBP to liquidate, without regard to AD duties, any entries during this gap period.

Concurrent AD duty investigations on preserved mushrooms from the Netherlands, Poland and Spain are ongoing, with preliminary determinations in those investigations published in November (see 2211020031).

AD Suspension of Liq Instructions

Suspension of liquidation resumes for all entries of subject merchandise entered on or after Jan. 18, the date that the final ITC affirmative injury determination was published.

AD Cash Deposit Instructions

An AD cash deposit requirement is also in effect for subject merchandise entered on or after Jan. 18, equal to the rates listed below:
