Vietnam Shrimp: Prelim Results of AD Admin Review
The Commerce Department has issued the preliminary results of its antidumping duty administrative review on frozen warmwater shrimp from Vietnam (A-552-802). The agency had no mandatory respondents to review, after all companies eligible for individual examination withdrew from the review. There are 100 companies remaining in the review, after some requests for review were withdrawn. Commerce has preliminarily determined that 96 of the companies under review are part of the Vietnam-wide entity, and are subject to the Vietnam-wide entity rate of 25.76%.

Export Compliance Daily combines U.S. export control news, foreign border import regulation and policy developments into a single daily information service that reliably informs its trade professional readers about important current issues affecting their operations.
Commerce said it is rescinding the review for six companies -- Bien Dong Seafood Co., Ltd.; Seavina Joint Stock Company; Soc Trang Seafood Joint Stock Company; STAPIMEX; Thong Thuan Cam Ranh Seafood Joint Stock Company; and T&T Cam Ranh -- because all requests for administrative review were withdrawn.
Commerce found another four companies -- BIM Foods Joint Stock Company; Minh Phu Hau Giang Seafood; Minh Phu Seafood Corporation; and Minh Qui Seafood Co., Ltd. -- did not have any exports to the U.S. during the period of review. As a result, the cash deposit rates currently in effect for these four companies will not change, and any entries during the period of review reported under their case numbers will be assessed duties at the 25.76% Vietnam-wide rate.
In its final results, Commerce will set assessments on importers of AD duties for subject merchandise entered Feb. 1, 2021, through Jan. 31, 2022. If these preliminary results are adopted unchanged, Commerce will assess duties at 25.76% for importers from the 96 Vietnam-wide companies. For a list of the companies, see Appendix II of the notice.
Only the 100 exporters of subject merchandise for which an administrative review was requested are covered by this review. Cash deposit rates for all other exporters will not change. Commerce has ordered liquidation "as entered" for entries during the period of review from all exporters for which a review was not requested or the request was withdrawn, in messages to CBP (ADCVDWeb Message # 2138410).
(The period of review is 02/01/21 - 01/31/22. See the notice for additional information, including the scope of the order, potential cash deposit and assessment instructions, etc.)
