Oct. 12 CBP Bulletin Proposes Revoke Rulings on Metal Storage Lockers, Cylinder Heads

In the Oct. 12 Customs Bulletin (Vol. 56, No. 40), CBP published a proposal to revoke one ruling on metal storage lockers and another on cylinder heads.

Comments on Proposals Due Nov. 11

CBP said consideration will be given to any written comments received by Nov. 11 before taking these actions. In addition, any party that has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations after the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Metal Storage Lockers

Items: A group of unequipped, locking, modular, shelved, metal storage lockers and cabinets that are available in different paint finishes.
Current: 9403.20.0081, free, “Other furniture and parts thereof: Other metal furniture: Other: Counters, lockers, racks, display cases, shelves, partitions and similar fixtures: Other.”
Proposed: 9403.20.0050, free, “Other furniture and parts thereof: Other metal furniture: Household: Other: Other.”
Reason: The metal storage lockers and cabinets are either placed directly on the floor or mounted to a wall to furnish houses -- specifically, household garages. Thus, the subject merchandise constitutes metal household furniture.
Proposed for revocation: NY N310710, dated April 14, 2020
Proposed new ruling: HQ H313152

Cast Iron Cylinder Heads

Items: Cast-Iron cylinder head and block castings, which are designed to be used with heavy duty diesel vehicle engines.
Current: 8409.99.91, 2.5%, “Parts suitable for use solely or principally with the engines of heading 8407 or 8408: Other: Other: Other: For vehicles of subheading 8701.20, or heading 8702, 8703 or 8704.”
Proposed: 8409.99.10, free, “Parts suitable for use solely or principally with the engines of heading 8407 or 8408: Other: Other: Cast-iron parts, not advanced beyond cleaning, and machined only for the removal of fins, gates, sprues and risers or to permit location in finishing machinery.”
Reason: The block castings are painted with primer and the cast-iron cylinder heads are coated with an oil only to prevent oxidation during transport.
