Sept. 14 CBP Bulletin Proposes to Modify Ruling on Fashion Show Items

Comments on Proposals Due Oct. 14

CBP said consideration will be given to any written comments received by Oct. 14 before taking these actions. In addition, any party that has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations after the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Fashion Show Items

Items: runway haute couture wearing apparel, headwear, footwear, jewelry, and accessories
Current: 9705.00.0070, free, “Collections and collectors’ pieces of zoological, botanical, mineralogical, anatomical, historical, archeological, paleontological, ethnographic or numismatic interest ... Archaeological, historical, or ethnographic piece.”
Proposed: Headings 4202 (certain accessories); 4203 (leather apparel and clothing accessories); 4203 (fur apparel and clothing accessories); 4303 (articles of artificial fur); various headings of chapter 61 and 62 (articles of apparel and clothing); 6402, 6403, 6404, and 6405 (footwear); 6504, 6505, and 6506 (various hats and headgear); and 7113 and 7116 (certain jewelry).
Reason: The fame of the brand does not bestow all of its haute couture runway merchandise with historical significance for purposes of classification in heading 9705. The items should be classified according to their constituent materials.
