China Amorphous Silica Fabric: Commerce Finds Circumvention by 70%-90% Silica Content Fabric
The Commerce Department will suspend liquidation and require antidumping and countervailing duty cash deposits on entries of amorphous silica fabric from China with a silica content of 70%-90%, it said in the preliminary results of an anti-circumvention inquiry. The agency found the 70%-90% amorphous silica fabric has undergone only minor modifications from goods subject to AD/CV duties, and should be covered by the AD/CVD orders on amorphous silica fabric from China (A-570-038/C-570-039).

Suspension of liquidation and cash deposit requirements take effect Nov. 24, 2021, the date Commerce published the initiation notice for this inquiry (see 2111230062), and apply country-wide to all 70%-90% silica amorphous silica fabric from China. Under the written scope of the AD/CVD orders on amorphous silica fabric, only amorphous silica fabric with a silica content above 90% is subject to the orders.
Commerce said none of the 10 companies it sought information from during the inquiry fully responded to its requests. As a result, Commerce sided with the domestic company that requested the anti-circumvention inquiry. Commerce intends to issue its final determination in this anti-circumvention inquiry by Dec. 2, 2022.
