Commerce Begins Anti-Circumvention Inquiry on Pipe and Tube From Vietnam

The Commerce Department is beginning an inquiry to determine whether various types of pipes and tubes made in Vietnam from hot-rolled steel produced in China, South Korea, India and Taiwan are circumventing antidumping and countervailing duty orders that would apply if the merchandise was produced and exported from those four countries, it said in a recent notice.

The agency will consider whether the pipe and tube products circumvent the AD/CVD orders on circular welded carbon quality steel pipe from China, circular welded non-alloy steel pipe from South Korea, welded carbon steel standard pipes and tubes from India, circular welded carbon steel pipes and tubes from Taiwan, circular welded non-alloy steel pipe from Taiwan, light-walled rectangular pipe and tube from China, light-walled rectangular pipe and tube from Korea, and light-walled welded rectangular carbon steel tubing from Taiwan.

The inquiry will apply countrywide to all exporters of covered pipe and tube products from Vietnam. Commerce will consider whether processing in Vietnam is minor or insignificant, or the value stemming from Chinese, South Korean, Indian and Taiwanese inputs is a “significant portion of the total value of the merchandise.”

Commerce may suspend liquidation and require cash deposits if it issues an affirmative preliminary determination in this anti-circumvention inquiry. These requirements may apply retroactively. The inquiries were requested by Atlas Tube, Bull Moose Tube, Maruichi American, Nucor Tubular Products, Searing Industries, Vest, Wheatland Tube and the United Steelworkers labor union.
