FMC Regulatory Agenda Includes Proposed Rule to Revise 'Outdated' Shipping Regs
The Federal Maritime Commission’s spring 2022 regulatory agenda includes a new mention of a proposed rule that could revise and clarify certain Shipping Act requirements. The rule would specifically propose to “modernize outdated requirements” and clarify existing ones associated with the filing of ocean common carrier and marine terminal operator agreements. The FMC plans to publish a notice of proposed rulemaking in August with a comment period ending in September and a final rule in December.

The agenda also continues to mention a proposed rulemaking that would revise its rules for Carrier Automated Tariffs, including whether carrier tariffs should be available “free of charge” and whether certain container documentation should include the names of all non-vessel operating common carriers in a shipping transaction (see 2205090006). The FMC requested feedback on the proposed changes earlier this year, with some saying the proposed revision to shipping documentation would create too large a burden on industry (see 2206210026). The FMC said it plans to issue a final rule in September.
