Vietnam Frozen Fish Fillets: Prelim Results of AD Admin Review

The Commerce Department issued the preliminary results of its antidumping duty administrative review on frozen fish fillets from Vietnam (A-552-801). In the final results of this review, Commerce will set assessment rates for subject merchandise, as may be applicable, entered August 2020 through July 2021.

Commerce initiated this administrative review with respect to 82 companies and the Vietnam-wide entity. The agency said it preliminarily determined that Hoa Phat Seafood Import-Export and Processing J.S.C. (Hoa Phat) did not establish eligibility for a separate rate and is, therefore, part of the Vietnam-wide entity. Commerce also said that it is rescinding the review for 66 companies and the Vietnam-wide entity, because the requests for review were withdrawn. And, Commerce said there are 15 companies that submitted satisfactory certifications of no shipments during the review period.

If Commerce continues to determine in the final results that the 15 companies determined to have no shipments, listed in Appendix III of the notice, in fact had no shipments of subject merchandise, any suspended entries of subject merchandise during the review period from these companies will be liquidated at the Vietnam-wide rate, currently $2.39/kg. For the remaining company subject to this review, Hoa Phat, which is part of the Vietnam-wide entity, Commerce will instruct CBP to liquidate its entries at the current rate for the Vietnam-wide entity (i.e., $2.39/kg). Assessment Rates

As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between Aug. 1, 2020, and July 31, 2021. If these preliminary results are confirmed in the final results, importers of subject merchandise from Hoa Phat entered during the period of review would be assessed AD duties at the $2.39/kg Vietnam-wide entity rate. For subject merchandise from all non-Vietnamese exporters of subject merchandise that have not received their own rate, the cash deposit rate will be the rate applicable to Vietnamese exporter(s) that supplied that non-Vietnamese exporter.
