Urea Ammonium Nitrate Solutions: Prelim CV Rates Take Effect

The Commerce Department is setting new countervailing duty cash deposit requirements for imports of urea ammonium nitrate solutions (UAN) from Trinidad and Tobago (C-274-809) and Russia (C-821-832), after finding illegal subsidization of the sole known producer/exporter of UAN from Trinidad and Tobago and of producers and exporters from Russia in the preliminary determinations of its CV duty investigations on subject goods. Suspension of liquidation and cash deposit requirements will take effect for entries on or after Dec. 3, the date that the preliminary determination is published in the Federal Register.

Commerce is also considering the imposition of antidumping duties on UAN from Trinidad and Tobago and Russia. The agency's preliminary AD duty determination is currently due Jan. 26, 2022. Commerce said it is aligning the final determination in this CVD investigation with the final determination in the companion antidumping duty investigation, based on a request made by the petitioner, CF Industries Nitrogen, LLC and its subsidiaries, Terra Nitrogen, Limited Partnership and Terra International (Oklahoma) LLC. Consequently, the final CVD determination will be issued on the same date as the final AD determination, which is currently scheduled to be issued no later than April 11, 2022, unless postponed.

CV Suspension of Liquidation and Cash Deposit Requirements

Commerce says it will instruct CBP to suspend liquidation for all entries of subject merchandise that is entered, or withdrawn from warehouse, for consumption on or after Dec. 3. Cash deposits of estimated CV duties will be required as follows:
