Aluminum Foil: Commerce Issues AD Duty Final Determinations

The Commerce Department issued its final determinations in the antidumping duty investigations on aluminum foil for Armenia (A-831-804), Brazil (A-351-856), Oman (A-523-815), Russia (A-821-828) and Turkey (A-489-844). Changes to cash deposit requirements set in these final determinations take effect Sept. 23, the date they are scheduled for publication in the Federal Register.

Commerce's final affirmative determination for Turkey means the agency will direct CBP to newly suspend liquidation for subject merchandise from Turkey for AD duty purposes. Suspension of liquidation had not been in place up until now for AD purposes as a result of Commerce's negative preliminary determination. Suspension of liquidation had still been in effect for CV duty purposes until July 2, though Commerce discontinued CV duty suspension of liquidation for Turkey as of July 3.

The next step is for the International Trade Commission to make its final injury determination, currently scheduled for Oct. 31, according to a Commerce fact sheet. If the ITC finds injury, Commerce will issue an AD duty order and duties will be made permanent. If the ITC finds no injury, the investigation will be terminated and all cash deposits refunded.

Commerce is also issuing its final determinations in the concurrent CV duty investigations on aluminum foil from Oman and Turkey, setting CV rates at 1.93% for Omani exporters, and 2.6% for Turkish exporters, though CV duty cash deposit requirements are on hold as of July 3 pending the ITC's final injury determination (see 2109220024).

Commerce will instruct CBP to continue to suspend liquidation for AD duty purposes (except for Turkey, for which suspension of liquidation begins Sept. 23) for all entries of subject merchandise, and require AD duty cash deposits as follows on entries on or after Sept. 23:
