Next Phase of APHIS Lacey Declaration Requirements Imminent, NCBFAA Says
The Animal and Plant Health Inspection Service will not begin enforcing its sixth phase of enforcement of Lacey Act declaration requirements July 1, but the agency expects no further delays to implementation (see 2008190010), the National Customs Brokers & Forwarders Association of America said in an emailed update June 28. APHIS will publish a Federal Register notice “any day” now announcing that enforcement will begin “on Aug. 1, or 30 days after the Federal Register notice is published,” the NCBFAA said, citing APHIS officials who spoke with an NCBFAA committee.

Products that will be newly covered by the Lacey Act requirements in Phase VI include essential oils in chapter 33; trunks, cases and suitcases in chapter 42; oriented strand board and wooden containers and pallets in chapter 44; musical instruments in chapter 92; and monopods, bipods, tripods and similar articles of wood in chapter 96. “APHIS will only require a Lacey declaration for products in harmonized tariff provision 4415 (wood pallets and containers) that are imported as the new commodity,” the NCBFAA said. “This will not include products that are used, recycled or reclaimed. Nor will it include loaded pallets or containers.”
