Amendments to Section 301 Tariffs Broaden Handful of Exclusion Descriptions

The Office of the U.S. Trade Representative announced new amendments to exclusions from Section 301 tariffs on Chinese imports. In one notice, an exclusion is apparently being removed under U.S. Note 20(x)(97) on multiphase motors, in statistical reporting number 8501.52.4000. A second notice modifies exclusions from the third set of Section 301 tariffs, as follows:

For U.S. Note 20(ll)(24), under subheading 7318.15.8069, bolts of alloy steel other than stainless steel, with shanks or threads with a diameter of 6 mm or more, the qualifying language will change from valued not over $0.10 per kg to valued not over $0.05 per piece.

In (ll)(25), for 7318.15.8069, perforated hollow hex head bolts (“banjo bolts”) of steel other than stainless, with shanks or threads with a diameter of 6 mm or more, the qualifying language will also change from valued not over $0.10 per kg to valued not over $0.07 per piece.

In exclusion (vv)(71), for 7007.19.0000, screen protectors of tempered safety glass, with adhesive on one side, in rectangular sheets, the eligibility has broadened. The sheets no longer have to have rounded corners; and the dimensions can be more varied. The new language is: each weighing at least 6 g but not more than 77 g, each measuring not less than 2.8 cm but not more than 28 cm in height, not less than 1.9 cm but not more than 21 cm in width, and not more than 0.1 cm in thickness.

For exclusion (vv)(116), under 8501.40.6040, single-phase AC electric motors, other than gear motors, the wattage, voltage, weight and dimensions stay the same, but it is broadened to allow motors with and without permanent split capacitors.

Exclusion (xx)(20), under subheading 4202.92.3120, backpacks of 66.66 tex polyester, measuring not more than 57 cm by 44 cm by 11 cm, will be broadened to allow backpacks with hydration systems.

For (xx)(43), under 8414.59.6540, DC blowers used in motor vehicle climate control systems, the sizes allowed are very slightly adjusted to allow more tolerance. The new language is: “each measuring no less than 323 mm by 122 mm by 102 mm and no more than 357 mm by 214 mm by 167 mm.”

In exclusion (xx)(44), for 8414.59.6560, DC centrifugal radial blowers, the wattage is broadened slightly, and so are the weight and dimensions. The new language is: each measuring not less than 345 mm by 122 mm by 102 mm and not more than 355 mm by 173 mm by 145 mm, of an output of 100 W to 285 W, and weighing at least 1.80 kg but no more than 2.72 kg.

In (yy)(75) for 8427.90.0090, pallet jacks, not self-propelled, there is slightly more tolerance in the steel forks. Instead of requiring 11 gauge steel forks, the gauge range can be between 9 and 12.

In (yy)(113), for 8708.99.6890, the reporting number shifts to 8708.40.7570, and the carbon steel flange forgings' use is no longer specified.

In (yy)(116), for 8708.99.6890, the reporting number also shifts to 8708.40.7570, and the carbon steel hub forgings' use is no longer specified.

For (yy)(117), under 8708.99.6890, the reporting number also shifts to 8708.40.7570, and the carbon steel park gear blanks' use is no longer specified.

Under (yy)(118), for 8708.99.6890, the reporting number also shifts to 8708.40.7570, and the carbon stator shafts' use is no longer specified.

In (yy)(138), for 9401.90.5081, greaseless cylinders, the maximum height dimension goes from 24.5 cm to 45 cm.

In exclusion (yy)(138), for 7308.40.0000, USTR adds cuplock configurations to the options: Equipment for scaffolding, comprising galvanized steel frames, posts, planks, bay braces, ledgers, components and accessories, for assembly in ringlock or cuplock configurations measuring at least 10 cm but not more than 3.3 m in height and at least 4 cm but not more than 8.8 m in width, weighing not more than 91 kg, with a load capacity not more than 2,750 kg.

In (qq)(35), for paper drinking straws, there is no change to qualification; the USTR just clarifies that it was described in statistical reporting number 4823.90.8600 prior to July 1, 2020; described in statistical reporting number 4823.90.8680 effective July 1, 2020.

That is also true for (vv)(79): Square-shaped barrels of stainless steel, each with slatted sides and a maximum capacity of 228 liters, which was described in statistical reporting number 7310.10.0010 prior to July 1, 2020, and is described in statistical reporting number 7310.10.0015 effective July 1, 2020.

And (aaa)(49) Drums and barrels, of stainless steel, presented empty, each with a capacity of at least 50 liters but not more than 60 liters and weighing at least 12 kg but not more than 15 kg, which was described in statistical reporting number 7310.10.0010 prior to July 1, 2020; described in statistical reporting number 7310.10.0015, effective July 1, 2020.
