Petitioner for Reclassification of Steel Tube Fittings Contesting CBP Rejection
Brennan Industries is contesting a CBP ruling about the reclassification of steel tube fittings, CBP said in a notice. The company previously sought reclassification of hydraulic system fittings in a petition to CBP (see 1602080030). Brennan argued that the connectors should be classified based on the specific use (see 1604140031), but CBP found they are parts of general use in a 2016 ruling letter it sent to the company.

Now, Brennan is fighting that decision. The company designated eight ports where it "believes that merchandise of the kind covered by the petition is being imported into the United States, and at which the Petitioner desires to protest," CBP said. The Port Directors are instructed to make information available to Brennan on merchandise covered by the petition that entered after Jan. 16 "in order that the petitioner may determine whether the entry presented raises the issue involved in the petition." Currently, these fittings are classified as ''a tube or pipe fitting of iron or steel, other, other, other'' under subheading 7307.99.50 with a duty rate of 4.3%. The proper classification for these objects is under duty-free subheading 8412.90.90 as “Other engines and motors, and parts thereof: Parts: Other," the company said.
