CBP Finds Country of Origin of Ethernet Cable, Transceiver Is China, for Government Procurement
An Ethernet cable and transceiver imported from China are considered to be of Chinese origin for U.S. government procurement purposes, CBP said in a final determination (here). Each of the physical products is assembled in China, and the software that allows the cable and transceiver to function is developed in China and Germany, respectively, before being “downloaded” onto the cable and transceiver after importation in the U.S. Because the downloading of software does not constitute programming and does not confer substantial transformation, the last substantial transformation of each article occurred in China, CBP said.
