Vietnam Shrimp: Prelim Results of AD Admin Review

The Commerce Department issued the preliminary results of its antidumping duty administrative review on frozen warmwater shrimp from Vietnam (A-552-802) (here). In the final results of this review, Commerce will set assessment rates for subject merchandise from companies under review entered February 2014 through January 2015.

Commerce has ordered liquidation "as entered" at the cash deposit rate in effect at time of entry for subject merchandise from exporters for which a review was not requested (here). Commerce is also rescinding this review for Seavina Joint Stock Company, and will order liquidation "as entered" for entries from Seavina as well.

Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. Commerce preliminarily calculated the following AD duty cash deposit rates:

Vietnam wide. Commerce found 51 companies did not cooperate in the review, and assigned them the 25.76% Vietnam-wide rate.

No Shipments. Commerce found 15 companies had no shipments to the U.S. during the period under review. If Commerce continues this finding in its final results, cash deposit requirements for these companies will not change as a result of this review. See Commerce's notice for a full list.

Assessment Rates

As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between Feb. 1, 2014 and Jan. 31, 2015. If these preliminary results are confirmed in the final results, importers of subject merchandise exported by Minh Phu Group and Soc Trang Seafood will be assessed AD duties at importer-specific rates. Importers of subject merchandise exported by the 30 average rate companies and the 51 China-wide companies will be assessed AD duties at the rates set in the final results. For the 15 companies that Commerce preliminary determined had no shipments during the period of review, any entries listing their case number would be liquidated at the Vietnam-wide rate.
