Thailand Shrimp: Prelim Results of AD Admin Review

The Commerce Department issued the preliminary results of its antidumping duty administrative review on frozen warmwater shrimp from Thailand (A-549-822) (here). Rates calculated in this review will be used to set assessment rates for importers of subject merchandise from 163 exporters that was entered February 2014 through January 2015.

Liquidation 'As Entered' for Entries from Exporters Not Subject to Review

Only the 163 exporters for which an administrative review was requested are covered by this review. Cash deposit rates for all other exporters will not change. Commerce ordered liquidation "as entered" for entries during the period of review from all exporters not under review (here). In these preliminary results, Commerce is also ending the review for one company, Gallant Ocean and Southport, that withdrew its request for review.

Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. If Thai Union continues to get a zero percent AD rate in the final results, it will not be subject to AD duty cash deposit requirements until further notice.

No Shipments. Commerce found two companies, Gallant Ocean and Lucky Union, had no shipments to the U.S. during the period under review. If Commerce continues this finding in its final results, cash deposit requirements for these two companies will not change as a result of this review.

Assessment Rates

As part of this administrative review, Commerce will also calculate final AD duty assessments on importers of subject merchandise exported by the companies under review that was entered between Feb. 1, 2014 and Jan. 31, 2015. If these preliminary results are confirmed in the final results, importers of subject merchandise exported by Thai Union would be liquidated without regard to AD duties. Importers of subject merchandise exported by A Foods would be assigned importer-specific rates. Importers of subject merchandise from the 158 "average rate" companies would pay AD duties at the 1.36% review average rate. For the two companies that Commerce preliminary determined had no shipments during the period of review, any entries listing their case number would be liquidated at the all others rate.
