PET Resin: Prelim AD Cash Deposit Rates Take Effect
The Commerce Department made a preliminary affirmative antidumping determination that polyethylene terephthalate (PET) resin from Canada (A-201-855), India (A-533-861), China (A-570-824) and Oman (A-520-810) are being sold in the U.S. at less than fair value. The agency will impose AD duty cash requirements on entries of subject merchandise from Canada, China and Oman beginning on Oct. 15. For entries from India, AD duty cash deposit requirements apply starting July 17.

PET resin from China and India is already subject to suspension of liquidation and countervailing duty cash deposit requirements, announced in Commerce's preliminary CV duty determinations on Aug. 14 (see 1508130057">1508130057 and 1508130058">1508130058).
Critical Circumstances for India; Cash Deposits Retroactive 90 Days
Commerce made a finding that all Indian companies increased their exports to the U.S. in the run up to the preliminary determination, in an attempt to get in as much product as possible before the imposition of cash deposit requirements. This "critical circumstances" finding by the agency allows it to retroactively suspend liquidation and require AD duty cash deposits for subject merchandise from India back to 90 days before the preliminary determination, i.e. July 17. Commerce made no such finding for Canada, India and China, so AD duty cash deposits for those three countries take effect Oct. 15.
AD Suspension of Liquidation and Cash Deposit Requirements
Commerce will instruct CBP to suspend liquidation for entries from Canada, China and Oman beginning Oct. 15, and for entries from India beginning July 17. Cash deposit rates will apply as follows:
