Mexico Sugar: Commerce Issues Final AD/CV Duty Determinations

The Commerce Department issued its final determinations in the antidumping and countervailing duty investigations on sugar from Mexico (A-201-845/C-201-846) (here) and (here). Suspension agreements signed in December 2014 remain in effect (see 1412240020), so liquidation of entries of subject merchandise is not suspended and cash deposit requirements are not in effect.

Resumption of the suspended investigations on sugar from Mexico was requested by two U.S. sugar refiners that rely on imported raw sugar (see 1501210022 and 1505010015). The next step is for the International Trade Commission to make its final injury determination, currently scheduled for Nov. 2. If the ITC finds injury, the suspension agreements will remain in effect. If the ITC finds no injury, the suspension agreements will be invalidated and the investigations terminated.

The suspension agreements will be subject to court challenge which, if successful, could result in Commerce issuing AD and CV duty orders setting duties at these final determination rates.
