India PET Film: Prelim Results of AD Admin Review

The Commerce Department issued the preliminary results of its antidumping duty administrative review on polyethylene terephthalate film, sheet and strip from India (A-533-824) (here). Rates calculated in this review will be used to set assessment rates for importers of subject merchandise from six exporters that was entered July 2013 through June 2014.

Liquidation 'As Entered' for Entries from Exporters Not Subject to Review

Only six exporters for which an administrative review was requested are covered by this review. Cash deposit rates for all other exporters will not change. Commerce ordered liquidation "as entered" for entries during the period of review from all exporters for which a review was not requested, in a message sent to CBP in August 2014 (here), subsequently corrected in October (here).

In these preliminary results, Commerce is also rescinding this review for MTZ Polyesters Ltd. and Uflex Ltd. after requests for their review were withdrawn. As such, these companies will have their entries liquidated "as entered," and their cash deposits rates will not change.

Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. If Jindal continues to get a zero percent AD rate in the final results, it will not be subject to AD duty cash deposit requirements until further notice. Commerce preliminarily calculated the following AD duty cash deposit rates:

Assessment Rates

As part of this administrative review, Commerce will also calculate final AD duty assessments on importers of subject merchandise exported by the companies under review that was entered between July 1, 2013 and June 30, 2014. If these preliminary results are confirmed in the final results, importers of subject merchandise exported by Jindal and entered during the period under review will not be assessed AD duties. Importers of subject merchandise from SRF will each be assigned importer-specific assessment rates.
