March 4 CBP Bulletin Proposes to Modify Rulings on Fishing Rod Holder, Gels
In the March 4 issue of the CBP Customs Bulletin (Vol. 49, No. 9) (here), CBP published notices that propose to modify rulings and similar treatment for the tariff classification of fishing rod holders and synthetic silica gels.

Comments on Proposals Due April 3
CBP said consideration will be given to any written comments received by April 3 before taking this action. In addition, any party who has received a ruling or decision on the merchandise that is subject to the proposed modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions, or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)
Proposals
CBP is proposing to modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke or modify any treatment it has previously accorded to substantially identical transactions.
Fishing Rod Holder with Boat Mount
| Item: A molded plastic fishing rod holder that holds a fishing rod while actively fishing. The rod holder attaches to a boat with a mount that is permanently screwed to the boat. |

| Reason: The rod holder and mount are excluded from classification in heading 9507 because the composite good comprises parts of general use which together form a fixture of the boat. They are packaged together and meant to fit one to the other in attachment to the boat. The plastic mount is a part of general use in that it is a mount. The fishing rod holder is a fitting for the mount in that it is an attachment to the mount. |

| Reason: CBP has previously classified amorphous forms of silica in subheading 2811.22.10 without reference to the bound water content. Also, the products don't contain any impermissible impurities, said CBP. |
