Rates Only Preliminary; Cash Deposit Rates From Previous Proceedings Still in Effect
These preliminary results do not affect current cash deposit requirements. For now, the most recent final AD rate calculated for each exporter is still applicable. If no final AD duty rate has ever been calculated for a company, then it is subject to the Vietnam-wide rate of 25.76%. The final results of this administrative review are currently due in July.
Cash Deposit Requirements
Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. If Fimex's zero percent AD rate is confirmed in the final results, the company will not be subject to AD duty cash deposit requirements until further notice. Commerce preliminarily calculated the following AD duty cash deposit rates:
| Exporter | AD Rate (Prelim) |
|---|---|
| Minh Phu Group (Minh Phu/Minh Phat/Minh Qui) | 1.5% |
| Fimex (Fimex/Sao Ta/Saota) | zero |
| Thuan Phuoc (Thuan Phuoc/Frozen Seafoods Factory 32/Seafoods and Foodstuff Factory/My Son Seafoods Factory) | 1.06% |
| Average rate for 31 companies | 0.93% |
(See Commerce's notice for a full list of the 31 companies that were preliminarily assigned new AD rates but were not under individual review.)
Assessment Rates
As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between Feb. 1, 2013 and Jan.1, 2014. If these preliminary results are confirmed in the final results, importers of subject merchandise exported by Fimex and entered during the period under review will not be assessed AD duties. Importers of subject merchandise from Minh Phu and Thuan Phuoc will each be assigned importer-specific assessment rates. Importers of shrimp from the 31 average rate companies will be assessed AD duties at the average rate calculated in the final results.
(The period of review is 02/01/13 -- 01/31/14. See notice for additional information, including the scope of the order, potential cash deposit and assessment instructions, etc.)
