China Garlic: Prelim Results of AD Admin Review

The Commerce Department issued the preliminary results of its antidumping duty administrative review on fresh garlic from China (A-570-831) (here). The agency preliminarily assigned the only two companies being individually reviewed, Golden Bird and Hejia, the China-wide rate because each company purportedly didn't demonstrate independence from Chinese government control. Rates set in the final results of this review will be used to determine assessments of AD duties on importers for entries from November 2012 through October 2013.

Rates Only Preliminary; Cash Deposit Rates From Previous Proceedings Still in Effect

These preliminary results do not affect current cash deposit requirements. For now, the most recent final AD rate calculated for each Chinese company is still applicable. If no final AD duty rate has ever been calculated for a company, then it is subject to the China-wide rate. The final results of this administrative review are currently due in April.

Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. Commerce preliminarily calculated the following AD duty cash deposit rates:

China-wide rate: The China-wide entity includes, among other companies, Hebei Golden Bird Trading Co., Ltd. (Golden Bird) and Jinxiang Hejia Co., Ltd.

No shipments: Commerce found 16 companies did not have any shipments to the U.S. during the period of review. If this finding is confirmed in the final results, rates for these companies will remain at levels set in previous reviews, and any entries claiming to be subject merchandise from these companies will be assessed duties at the China-wide rate. Assessment Rates

As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between Nov. 1, 2012 and Oct. 31, 2013. If the agency makes no changes in its final results, importers will be assessed AD duties at the rates listed above.
