China PET Film: Prelim Results of AD Admin Review

The Commerce Department issued the preliminary results of its antidumping duty administrative review on polyethylene terephthalate film, sheet and strip from China (A-570-924) (here). Once Commerce issues its final results, the agency will use the AD rates calculated in this review to set new cash deposit rates for some companies and assessments of AD duties on importers for entries between November 2012 and October 2013.

Rates Only Preliminary; Cash Deposit Rates From Previous Proceedings Still in Effect

These AD duty rates are only preliminary, and do not change current AD duty rates. Commerce may still change its calculations when it issues the final results of this administrative review. For now, the most recently calculated final AD rate is still applicable. If no final AD duty rate has ever been calculated for a company, then it is subject to the China-wide rate of 76.72%. The final results of this administrative review are currently due in April.

Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register.

Assessment Rates

Commerce will use these rates to calculate assessments of AD duties on importers for entries between Nov. 1, 2012 and Oct. 31, 2013. Commerce will calculate importer-specific assessment rates for importers of subject merchandise exported by Green Packing and Wanhua. Fuwei Films (Shandong) Co., Ltd. and Sichuan Dongfang Insulating Material Co., Ltd. declared they did not export to the U.S. during the period of review, so any entries declared to have been exported by those two companies would be subject to the China-wide rate.
