Italy Pasta: Delverde Not Eligible for Defunct Predecessor's Duty Exemption
The Commerce Department ruled that Delverde Industrie Alimentari is not the successor to the now-defunct Del Verde S.p.A. and is not eligible for the latter’s antidumping duty rate, in the final results of a changed circumstances review on pasta from Italy (A-475-818) issued Sept. 19. As in its preliminary results (see 14051519), Commerce found that changes to the company’s ownership and production activities during Del Verde’s bankruptcy and subsequent restructuring and asset sale to an Argentine firm means the new Delverde is much different company. Del Verde was exempt from the AD duty order on pasta from Italy. Delverde will continue to get its current 13.09% AD duty rate.
