Malaysia, Thailand and Vietnam Pressure Pipe: Details of AD Duty Orders
The Commerce Department issued antidumping duty orders on welded stainless pressure pipe from Malaysia (A-557-815), Thailand (A-549-830) and Vietnam (A-552-816). The order details a "gap period" of June 11-24 of no AD duty liability due to the expiration of the "provisional measures" period.

With the issuance of this order, AD duties on pressure pipe from Malaysia, Thailand and Vietnam become permanent, and can only be ended in certain circumstances, like a sunset review or a changed circumstances review. Commerce will now begin conducting annual administrative reviews on pressure pipe from Malaysia, Thailand and Vietnam, if requested, to determine final assessments of AD duties on importers and make changes to AD duty cash deposit rates.
Refund of Malaysia Cash Deposits Collected Oct. 9 - Jan. 6
Although Commerce found in its preliminary determination that "critical circumstances" existed for imports of pressure pipe from Malaysia and made suspension of liquidation retroactive 90 days, the International Trade Commission decided in June to overrule that decision. As a result, Commerce will refund AD duty cash deposits collected on shipments of pressure pipe from Malaysia entered between Oct. 9 and Jan. 6. Cash deposit requirements for pressure pipe from Malaysia entered on or after Jan. 7 are still in effect.
Gap Period of No AD Suspension of Liq or AD Duties for July 7-24
For these three investigations, the six-month provisional measures period for which the AD suspension of liquidation may remain in effect before the order is issued began on Jan. 7 (the date of the preliminary determination) and ended on July 6.
As the International Trade Commission's final affirmative injury determination is being published on July 25, Commerce is instructing CBP to terminate AD suspension of liquidation and to liquidate, without regard to AD duties, unliquidated entries of subject merchandise from Malaysia, Thailand, and Vietnam entered on or after July 7, and through July 24 (the gap period).
(For subject merchandise entered on or after Jan. 7 through July 6, suspension of liquidation and AD duty liability remains in effect.)
AD Suspension of Liq Instructions
Suspension of liquidation resumes for all entries of subject merchandise from Malaysia, Thailand and Vietnam entered on or after July 25, the date that the final ITC affirmative injury determination is published.
AD Cash Deposit Instructions
An AD cash deposit requirement is also in effect for subject merchandise from Malaysia, Thailand and Vietnam entered on or after July 25. Commerce will instruct CBP to require, at the same time as importers deposit estimated duties, a cash deposit equal to the AD duty rates listed below for all entries entered on or after July 25, as follows:
