India OCTG: Commerce Issues Final AD Determination
The Commerce Department issued its final determination in the antidumping duty investigation on oil country tubular goods from India (A-533-857). The agency for the first time found dumping by GVN/MSL/JPL, so it will direct CBP to suspend liquidation of all entries from Jindal SAW on or after July 18. For all other Indian companies, Commerce continued to find dumping, so it will direct CBP to continue to suspend liquidation. After adjusting for export subsidies, cash deposit rates for all Indian companies are zero percent. Changes to AD duty cash deposit requirements take effect July 18.

The next step is for the International Trade Commission to make its final injury determination, currently scheduled for Aug. 25. If the ITC finds injury, Commerce will issue an AD duty order and duties will be made permanent. If the ITC finds no injury, the investigation will be terminated and all cash deposits will be refunded.
Commerce Reverses Retroactive Sus of Liq for Jindal SAW
In its preliminary determination, Commerce found critical circumstances exist for Jindal SAW. As such, it ordered CBP to retroactively suspend liquidation and require AD duty cash deposits back to Nov. 27.
In this final determination, Commerce is reversing its finding of critical circumstances for Jindal SAW. As such, it will direct CBP to liquidate retroactively suspended entries without regard to AD duties, which effectively results in a refund of any cash deposits collected on entries from Jindal between Nov. 27 and Feb. 24.
Estimated AD Cash Deposit Rates
Effective July 18, Commerce will instruct CBP to require an AD cash deposit for all imports of subject merchandise from India equal to the AD rates (as adjusted for export subsidies) listed below.
