China Aluminum Extrusions: Prelim Results of AD Admin Review

The Commerce Department issued the preliminary results of its antidumping duty administrative review on aluminum extrusions from China (A-570-967). The agency calculated a preliminary AD rate of zero percent for Kromet, and assigned 18 non-individually investigated companies an average rate. Commerce also preliminarily put 26 companies in the China-wide entity because they allegedly didn't prove independence from Chinese government control.

Rates Only Preliminary; Cash Deposit Rates From Previous Proceedings Still in Effect

These preliminary results are only preliminary, and are not in effect. Commerce may still change its calculations when it issues the final results of this administrative review. For now, the most recent final AD rate calculated for each Chinese company is still applicable. If no final AD duty rate has ever been calculated for a company, then it is subject to the China-wide rate. The final results of this administrative review are currently due in October.

Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. Because Kromet was preliminarily assigned a zero AD duty rate, if its rate is confirmed in the final results it will not be subject to AD duty cash deposit requirements until further notice. Commerce preliminarily calculated the following AD duty cash deposit rates:

China-wide rate. Commerce preliminarily found 26 companies did not demonstrate independence from control by the Chinese government. As such, it found these companies are not entitled to their own AD rates, but will instead be subject to the higher China-wide rate. No shipments. Commerce said three exporters certified that they made no shipments to the U.S. of subject merchandise during the period of review. As such, Commerce preliminarily decided not to calculate a new AD duty rate for the following companies: Hong Kong Gree Electric Appliances Sales Limited; Jiuyuan Co., Ltd.; and Shenzhen Hudson Technology Development Co., Ltd.

Assessment Rates

As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between May 1, 2012 and April 30, 2013. If these preliminary results are confirmed in the final results, importers of subject merchandise exported by Kromet and entered during the period under review will not be assessed AD duties.
