Thailand Retail Bags: Prelim Results of AD Admin Review
The Commerce Department issued the preliminary results of its antidumping duty administrative review on polyethylene retail carrier bags from Thailand (A-549-821). The agency preliminarily assigned Beyond Packaging a high penalty rate because of the company's alleged noncooperation. If these preliminary results are confirmed in the final results, all entries of subject merchandise between August 2012 and July 2013 produced or exported by Beyond Packaging will be assessed AD duties at that rate.

Rates Only Preliminary; Cash Deposit Rates From Previous Proceedings Still in Effect
These preliminary results are only preliminary, and are not in effect. Commerce may still change its calculations when it issues the final results of this administrative review. For now, the most recent final AD rate calculated for each Thai company is still applicable. If no final AD duty rate has ever been calculated for a company, then it is subject to the all others rate of 4.69%. The final results of this administrative review are currently due in October.
Cash Deposit Requirements
Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. Commerce preliminarily calculated the following AD duty cash deposit rates:
| Exporter | AD Rate |
|---|---|
| Beyond Packaging Co., Ltd. | 122.88% |
| Dpac Inter Corporation Co., Ltd. | 4.69% |
| Elite Poly and Packaging Co., Ltd. | 4.69% |
| Poly World Co., Ltd. | 4.69% |
| Triple B Pack Company Limited | 4.69% |
| Two Path Plaspack Co., Ltd. | 4.69% |
Assessment Rates
As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between Aug. 1, 2012 and July 31, 2013. If these preliminary results are confirmed in the final results, Commerce would assess AD duties on importers of subject merchandise from Beyond Packaging at the 122.88% penalty rate. It would assess AD duties on entries from Dpac, Elite, Poly World, Triple B and Two Path at 4.69%.
(The period of review is 08/01/12 -- 07/31/13. See notice for additional information, including the scope of the order, potential cash deposit and assessment instructions, etc.)
