Mexico Rebar: Prelim AD Cash Deposit Rates Take Effect, Retroactive 90 Days for Some
The Commerce Department made a preliminary affirmative antidumping determination that steel concrete reinforcing bar from Mexico (A-201-844) is being sold in the U.S. at less than fair value. The agency will impose AD duty cash requirements on all Mexican companies, and will make cash deposits on entries from all companies except Grupo Simec retroactive 90 days because of a preliminary finding of "critical circumstances." For Grupo Simec, AD duty cash deposits will be required for entries beginning April 24. For all other Mexican exporters, these rates take effect Jan. 24.

Commerce Finds Critical Circumstances; Cash Deposits Retroactive 90 Days
Commerce made a finding that some Mexican companies increased their rebar exports to the U.S. in the run up to the preliminary determination, in an attempt to get in as much product as possible before the imposition of AD duties. This "critical circumstances" finding by the agency allows it to retroactively suspend liquidation for all Mexican companies except Grupo Simec back to 90 days before the preliminary determination, i.e. Jan. 24.
AD Suspension of Liquidation and Cash Deposit Requirements
Commerce will instruct CBP to suspend liquidation for all entries of subject merchandise from Mexico from Grupo Simec that are entered, or withdrawn from warehouse, for consumption on or after April 24. Suspension of liquidation and AD duty cash deposit requirements for Deacero and Grupo Acerero and all other exporters of subject merchandise take effect Jan. 24. The preliminary AD cash deposit rates are as follows::
