India Shrimp: Prelim Results of AD Admin Review

The Commerce Department issued the preliminary results of its antidumping duty administrative review on frozen warmwater shrimp from India (A-533-840). The agency calculated preliminary AD rates for two companies, Devi Fisheries and Falcon Marine, and preliminarily assigned an average of those two rates to about 200 other companies.

Rates Only Preliminary; Cash Deposit Rates From Previous Proceedings Still in Effect

These preliminary results are only preliminary, and are not in effect. Commerce may still change its calculations when it issues the final results of this administrative review. For now, the most recent final AD rate calculated for each Indian company is still applicable. If no final AD duty rate has ever been calculated for a company, then it is subject to the all others rate of 10.17%. The final results of this administrative review are currently due in July.

Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register.

Assessment Rates

As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between Feb. 1, 2012 and Jan. 31, 2013. For subject merchandise from Devi Fisheries and Falcon Marine, Commerce said it will calculate a specific AD duty rate for each importer based on entry data. For subject merchandise exported by other companies, Commerce will calculate an assessment rate based on the average of the Devi Fisheries and Falcon Marine AD duty rates.
