Rates Only Preliminary; Cash Deposit Rates From Previous Proceedings Still in Effect
These preliminary results are only preliminary, and are not in effect. Commerce may still change its calculations when it issues the final results of this administrative review. For now, the most recent final AD rate calculated for each Vietnamese company is still applicable. If no final AD duty rate has ever been calculated for a company, then it is subject to the Vietnam-wide rate. The final results of this administrative review are currently due in July.
Cash Deposit Requirements
Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. Commerce preliminarily calculated the following AD duty cash deposit rates:
| Exporter | AD Rate |
|---|---|
| Minh Phu Group | 4.98% |
| Soc Trang Seafood Joint Stock Company | 9.75% |
| Average rate for 30 companies | 6.37% |
| Vietnam-wide rate | 25.76% |
Review average rate. Commerce preliminarily assigned the 6.37% AD duty rate to BIM Seafood, Camau Frozen Seafood, C.P. Vietnam, Cadovimex, Cafatex, Camau Seafood Processing, Can Tho (CAFISH), Coastal Fisheries (COFIDEC), Cuu Long, Danang/Tho Quang, Gallant Ocean, Hai Viet, Investment Commerce Fisheries (Incomfish), Kim Anh, Minh Hai, Seaprodex, Seaprimexco, Nha Trang Fisheries, Nha Trang Seafoods, Phu Cuong, Phuong Nam, Quoc Viet, Sao Ta, Thong Thuan, Thuan Phuoc, UTXI, Viet Foods, Vietnam Clean Seafood (Vina Cleanfood), and Viet I-Mei.

Assessment Rates
As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between Feb. 1, 2012 and Jan. 31, 2013. Commerce said it will calculate a specific AD duty rate for each importer based on entry data. No AD duties will be assessed if the exporter receives a zero AD duty rate.
(The period of review is 02/01/12 -- 01/31/13. See notice for additional information, including the scope of the order, potential cash deposit and assessment instructions, etc.)
