China Graphite Electrodes: Prelim Results of AD Admin Review

The Commerce Department issued the preliminary results of its antidumping duty administrative review on small diameter graphite electrodes from China (A-570-929). The agency calculated preliminary AD rates for seven companies, and preliminarily said 13 other companies will get the high China-wide entity rate because they didn't demonstrate independence from state control.

Rates Only Preliminary; Cash Deposit Rates From Previous Proceedings Still in Effect

These preliminary results are only preliminary, and are not in effect. Commerce may still change its calculations when it issues the final results of this administrative review. For now, the most recent final AD rate calculated for each Chinese company is still applicable. If no final AD duty rate has ever been calculated for a company, then it is subject to the China-wide rate. The final results of this administrative review are currently due in July.

Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. Commerce preliminarily calculated the following AD duty cash deposit rates:

China-wide rate. Commerce preliminarily found 13 companies did not demonstrate independence from control by the Chinese government. As such, it found these companies are not entitled to their own AD rates, but will instead be subject to the higher China-wide rate. These companies are Fushun Jinly Petrochemical Carbon Co., Ltd.; Fangda Lanzhou Carbon Joint Stock Company Co. Ltd.; Jilin Carbon Graphite Material Co., Ltd.; Lanzhou Carbon Co., Ltd.; Lanzhou Carbon Import & Export Corp.; Lanzhou Hailong New Material Co.; Lanzhou Hailong Technology; Liaoning Fangda Group Industrial Co., Ltd.; Sinosteel Anhui Co., Ltd.; Sinosteel Corp.; Sinosteel Jilin Carbon Plant; Sinosteel Jilin Carbon Imp. & Exp. Co., Ltd.; Sinosteel Sichuan Co., Ltd.

No shipments. Commerce said one exporter -- UK Carbon and Graphite Company Co., Ltd. -- certified that it made no shipments to the U.S. of subject merchandise during the period of review. As such, Commerce preliminarily decided not to calculate a new AD duty rate for the company.

Assessment Rates

As part of this administrative review, Commerce will also calculate the AD duties it will assess on importers for entries of subject merchandise entered between Feb. 1, 2012 and Jan. 31, 2013. Commerce said it will calculate a specific AD duty rate for each importer based on entry data. No AD duties will be assessed if the exporter receives a zero AD duty rate.
