FMC Amends Rules of Practice and Procedure

The Federal Maritime Commission is revising its rules of practice and procedure, effective July 29, to update and clarify the rules and to reduce the burden on parties to proceedings before the Commission. The key changes are:

  • amending Section 502.25 to include provisions outlining the presiding officer's authority and functions
  • amending Section 502.27 to streamline the Commission’s rules regarding practice before the FMC by non-lawyers. The rule is updated to provide that the application for admission may be obtained on-line or from the Secretary.
  • amending Section 502.42 to simplify language describing when the Bureau of Enforcement may become a party to proceedings.
  • modifying 502.43 to harmonize the language of the Federal Rules of Civil Procedure
