BIS Amends Name, Facilities and EECNs for 1 India & 5 China VEUs

The Bureau of Industry and Security has issued a final rule, effective February 24, 2012, which amends Supplement No. 7 to Part 748 of the Export Administration Regulations to revise the existing Authorization Validated End-User listings for GE India Industrial Pvt Ltd.; Applied Materials (China), Inc.; Boeing Tianjin Composites Co. Ltd.; CSMC Technologies Corporation; Lam Research Corporation; and Semiconductor Manufacturing International Corporation.

BIS Updates Name and Eligible Items of GE India Industrial Pvt Ltd.

BIS’ final rule updates the company’s name from GE India to GE India Industrial Pvt Ltd, and removes an unnecessary address from the eligible facilities (destinations) column (AIFACS).

In addition, this rule amends the list of items eligible for export, reexport and transfer (in-country) for GE India Industrial Pvt Ltd. as follows:

  • Removal of ECCN 2E983 from the list of eligible items for the GE India Technology Centre Private Ltd. eligible facility
  • Addition of ECCNs 2E003.f and 9E003.a.2 for all GE India eligible destinations

With this amendment, all GE India Industrial Pvt Ltd. eligible facilities may receive the same eligible items.

Revision to the List of Eligible Items for Applied Materials

This rule adds ECCN 3B001.a as an eligible item for all Applied Materials (China), Inc. facilities.

Correction of Facility Address, Revision to Eligible Items for Boeing Tianjin

BIS’ final rule corrects the spelling of the street name in the address for Boeing Tianjin Composites Co., Ltd.’s eligible facility.1

Additionally, the final rule removes ECCN 2B001.a from the parenthetical limiting statement for ECCN 1E001. Pursuant to this revision, the export, reexport, or transfer (in-country) of 1E001 technology for the development or production of items controlled by ECCN 2B001.a is no longer authorized to Boeing Tianjin under Authorization VEU. This amendment is not the result of activities of concern by Boeing Tianjin.

Revisions to the List of Eligible Facilities for CSMC

This rule updates the address of CSMC Technologies Fab 2 Co., Ltd., a CSMC Technologies Corporation eligible facility.1

Revisions to List of Eligible Facilities for Lam Research Corporation

BIS’ final rule amends Lam’s list of eligible facilities by adding three and updating six addresses of the company’s list of facilities eligible to receive items under Authorization VEU. The following eligible facilities have been added1:

  • Lam Research International Sarl (Lam Beijing Warehouse)
  • Lam Research Semiconductor (Suzhou) Co., Ltd. (Suzhou)
  • Lam Research International Sarl (Lam Beijing Warehouse)

The addresses of the following eligible facilities were amended by this final rule1:

  • Lam Research (Shanghai) Service Co.
  • Lam Research International Sarl (Lam Shanghai Warehouse)
  • Lam Research International Sarl (Lam Shanghai Warehouse; WGQ Bonded Warehouse)
  • Lam Research Service Co., Ltd. (Beijing Branch)
  • Lam Research Service Co., Ltd. (Wuxi)
  • Lam Research Service Co., Ltd. (Wuhan)

Revision to the List of Eligible Items for SMIC

In this rule, BIS amends Semiconductor Manufacturing International Corporation’s eligible items to correspond with changes to an entry on the CCL. Specifically, ECCN 2B350.i.4 is being replaced with ECCN 2B350.i.3 to conform to the harmonization of fluoropolymer classifications in the EAR.

BIS is also updating the citations in the “Federal Register Citation” column for SMIC to include the citation for the November 9, 2011 revision to SMIC’s list of eligible facilities. This information was inadvertently omitted from the November 9 notice.
