CITA Receives 2 More DR-CAFTA "Commercial Availability" Requests for Certain Crepe Fabric

The Committee for the Implementation of Textile Agreements has issued two notices announcing that interested entities can submit Offers to Supply by November 28, 2011, or provide a Rebuttal to an offer by December 2, regarding two "commercial availability" requests it received under the DR-CAFTA, on behalf of Hansoll Textile, Ltd.

  • alleging that certain cotton/nylon/spandex raschel knit open work crepe fabric with a blistered surface with interstices (printed or piece dyed) classifiable under HTS subheading 6005.24.00 or 6005.22.00, respectively, cannot be supplied by the domestic industries or Costa Rica, the Dominican Republic, El Salvador, Guatemala, Nicaragua, or Honduras industries in commercial quantities in a timely manner; and
  • requesting that CITA consider allowing these fabrics to be sourced from outside the DR-CAFTA region without destroying eligibility for DR-CAFTA treatment of certain apparel.

Offers to Supply Fabrics & Rebuttal Submissions

Those parties wishing to submit a response with an offer to supply the subject fabrics or provide a rebuttal submission to a response should follow the revised procedures detailed in CITA's modified final procedures for DR-CAFTA commercial availability requests. CITA Commercial Availability Determination due by December 27

The commercial availability investigation is projected to be completed by December 27, 2011.
