MARAD to Hold Oct 3 Public Meeting on Its Review of Cargo Preference Regs
The Department of Transportation's Maritime Administration (MARAD) will hold a public meeting on October 3, 2011 to receive comments on the continued validity and effectiveness of its Cargo Preference regulations. MARAD is considering amending these regulations in accordance with the President's July Executive Order on independent agency regulatory review1.

MARAD Considering to Amends Regs to Benefit Shippers as Part of Regulatory Review
This meeting is designed to solicit public views and gather additional information for MARAD's regulatory review. Accordingly, MARAD is considering amending existing regulations in order to provide for a more easily administered system of regulations to benefit shippers and shipper agencies in meeting statutory requirements.
Comments Sought on Transport of Cargo for Gov't Programs on U.S.-Flag Vessels
MARAD is soliciting public comment concerning amendment of its cargo preference regulations governing the carriage of imports and exports, other than those shipped by the Department of Defense. MARAD is considering updating and clarifying its regulations at 46 CFR Parts 381 and 382, and establishing procedures to ensure compliance with the cargo preference statutes and regulations in a new Part 383.
Part 381 implements the requirements of Section 901 of the Merchant Marine Act of 1936, as amended. The Act requires that a specified percentage of ocean-going cargo generated by Government programs be transported in U.S.-flag, privately owned, commercial vessels. The Act also authorizes MARAD to issue regulations governing the administration of these cargo preference requirements.

The meeting will be held in Washington, DC on October 3, 2011 at 1:00 pm -- 4:00 pm. The meeting will also be broadcast live via web streaming and a listen-only telephone line. 1On January 18, 2011, the President issued EO 13563, "Improving Regulation and Regulatory Review," which requires retrospective review of significant rules. EO 13563 requires each Executive Branch agency to develop a preliminary plan to periodically review its existing regulations to determine whether any regulations should be modified, streamlined, expanded, or repealed so as to make the agency’s regulatory program more effective or less burdensome in achieving its regulatory objectives.
