Russia Ammonium Nitrate: AD Duty Order Issued, Etc.

The International Trade Administration has is terminating the agreement suspending the antidumping duty investigation on solid fertilizer grade ammonium nitrate from Russia (A-821-811) and is issuing an AD order, effective May 2, 2011.

Russian Gov't Withdrew from Suspension Agreement

The ITA suspended the AD investigation on ammonium nitrate from Russia, effective May 19, 2000, based on an agreement between the ITA and the Ministry of Trade of the Russian Federation (MOT) (the predecessor to the Ministry of Economic Development (MED)) accounting for substantially all imports of ammonium nitrate from Russia, wherein the MOT agreed to restrict exports of ammonium nitrate from all Russian producers/exporters to the U.S. and to ensure that such exports were sold at or above the agreed reference price.

On February 22, 2011, the MED stated that it was withdrawing from the suspension agreement. (See ITT's Online Archives or 06/19/00 news, 00061620, for BP summary of the ITA's suspension of the investigation.)

Suspension of Liquidation Begins May 2

Pursuant to the MED's withdrawal from the suspension agreement, the ITA will issue an antidumping duty order and instruct U.S. Customs and Border Protection to suspend liquidation of entries of subject merchandise with a time of entry on or after May 2, 2011 (which is 60 days from the date the ITA received the letter from MED stating its withdrawal from the agreement).

Cash Deposits Effective May 2

The ITA will also direct CBP to collect cash deposits on entries of subject merchandise with a time of entry on or after May 2, 2011, at the following estimated AD duty rates:
