Italy Pasta: Prelim CV Determination to Revoke Gluten-Free Pasta
The International Trade Administration has issued the preliminary results of its countervailing duty changed circumstances review of certain pasta from Italy to determine whether revocation of the CV duty order is warranted with respect to gluten-free pasta.

ITA Preliminarily Finds No Domestic Interest in Gluten-Free Pasta Imports
The ITA has preliminarily confirmed that New World Pasta Company, Dakota Growers Pasta Company, and American Italian Pasta Company (collectively, the petitioners) have no interest in CV duty relief from imports of gluten-free pasta. The petitioners have confirmed that they represent “substantially all” of the production of the domestic like product.
Based on the expression of no interest by the petitioners, and absent any objection by any other interested parties, the ITA has preliminarily determined that the domestic producers of the like product have no interest in the continued application of the CV duty order on certain pasta from Italy to the merchandise that is subject to this request.
ITA to Exclude Gluten-Free Pasta from Scope of CV Order upon Final Results
The ITA intends to change the scope of the CV duty order on certain pasta from Italy to include the following exclusion: Excluded from the scope is gluten-free pasta.
If final revocation occurs, the ITA will instruct U.S. Customs and Border Protection to end the suspension of liquidation for the merchandise covered by the revocation on the effective date of the notice of revocation and to release any cash deposit or bond. The current requirement for a cash deposit of estimated CV duties on all subject merchandise will continue unless and until it is modified pursuant to the final results of this changed circumstances review.
The ITA will issue the final results no later than 270 days after September 13, 2010, or within 45 days if all parties agree to the preliminary results.
