AD Liquidation, Cash Deposits Refunded Prior to Final ITC Determination

Because the International Trade Commission's final injury determination is based on the threat of material injury and is not accompanied by findings that injury would have resulted, but for the imposition of suspension of liquidation of entries since the preliminary determination, U.S. Customs and Border Protection is required to release any bond or other security, and refund any cash deposit of estimated AD duties posted from the ITA's preliminary determination until the publication of the ITC's final determination of threat of material injury.

Therefore, the ITA will instruct CBP to terminate the AD suspension of liquidation for entries of coated paper from Indonesia with a time of entry prior to November 17, 2010 (the publication date of the ITC’s final threat of injury determination)1.

The ITA will also instruct CBP to refund any estimated AD cash deposits made and release any bonds posted between the publication of the ITA’s preliminary determination on May 6, 2010 through November 16, 2010.

AD Suspension of Liquidation for Nov 17 and After

The ITA will direct CBP to require AD suspension of liquidation for all entries of subject merchandise from China with a time of entry on or after November 17, 2010.

AD Cash Deposit Requirements

The ITA will also instruct CBP to require, at the same time as importers would normally deposit estimated duties, estimated AD cash deposits on entries of subject merchandise from Indonesia with a time of entry on or after November 17, 2010 at the AD duty rates below2.

1The Federal Register notice incorrectly states that the ITA will instruct CBP to terminate the AD suspension of liquidation for entries prior to November 12. ITA sources confirm that November 17, 2010 (the Federal Register publication date) is the correct date.

2These estimated AD duty rates are unchanged from the final determination.
