China Glycine: Initiation of AD Anti-Circumvention Inquiry

The International Trade Administration is initiating an anti-circumvention inquiry to determine whether certain imports of technical-grade glycine from India are circumventing the antidumping duty order on glycine from China (A-570-836).

ITA to Determine Whether 3 Indian Companies are Circumventing China Order

The ITA will determine whether the activities of three Indian companies, Salvi Chemical Industries (allegedly affiliated with Nutracare International), Paras Intermediates Pvt. Ltd., and AICO Laboratories India Ltd., are circumventing the AD duty order on glycine from China.

Specifically, the domestic interested parties allege that Salvi, Paras, and AICO are circumventing the China order by importing technical-grade glycine from companies in the China, processing1 and/or repackaging the China-origin glycine, then exporting the finished product to the U.S., marked as Indian-origin glycine.

They further argue that the merchandise being imported into the U.S. from India from Salvi, Paras and Aico is of the same class or kind as that subject to the China order, among other things.

Suspension of Liquidation, Cash Deposit if Preliminary Affirmative Determination

If the ITA issues a preliminary affirmative determination, it will then instruct U.S. Customs and Border Protection to suspend liquidation and require a cash deposit of estimated duties on the merchandise.

The ITA intends to issue its final determination within 300 days of October 28, 2010.
