Turkey Rectangular Pipe and Tube: Final Results of AD Duty Admin Review

The International Trade Administration has issued the final results of its antidumping duty administrative review of light-walled rectangular pipe and tube from Turkey for the period of January 30, 2008 through April 30, 2009 (A-489-815).

1The ITA has found an AD duty rate of zero for Toscelik, therefore, no estimatedcash deposit is required; however, it remains subject to the order.

(a) If the exporter is not a firm covered in this review or the AD investigation, but the manufacturer is, the estimated AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and

(b) If neither the exporter nor the manufacturer is a firm covered in this or any previous review conducted by the ITA, the estimated AD duty cash deposit rate will be the all-others rate from the AD investigation of 27.04%.

Assessment Instructions

The ITA will issue assessment instructions to U.S. Customs and Border Protection for Toscelik within 15 days after October 4, 2010. The ITA has calculated importer-specific (or customer-specific) ad valorem duty assessment rates for subject merchandise.

The ITA adds that for entries of subject merchandise during the review period produced by Toscelik for which Toscelik did not know the merchandise was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the 27.04% all-others rate from the AD investigation if there is no company-specific rate for the intermediary involved in the transaction.
