House-Passed All-American Flag Act Would Require “100% U.S. Made”

On September 30, 2010, the House of Representatives passed H.R. 2853, the All-American Flag Act. As passed by the House, H.R. 2853 would require:

  • that all flags of the U.S., regardless of size, acquired for use by the federal government to be 100% manufactured in the U.S., from articles, materials, or supplies 100% of which are grown, produced, or manufactured in the U.S.; and
  • in carrying out the above requirement, the federal government to purchase only flags from a manufacturer that certifies that: (i) it does not employ aliens who are not authorized to be employed in the U.S.; and (ii) it participates in the E-Verify Program.

The above requirements would take effect for purchases of flags made on or after 180 days after enactment.

Current law requires only 50% of materials to be U.S. made. According to the House report on H.R. 2853, current law only requires 50% of the materials used to manufacture the flags for use by the federal government to be American made.

(Although the House has passed H.R. 2853, it is not yet in effect. Generally, in order for a bill to be implemented, identical versions of that bill must be passed by both the House and Senate, and then the bill must be approved (enacted) by the President.)
