DoD Discusses Ways to Improve Export License Processing Times, Etc.

At the Bureau of Industry and Security’s recent Annual Export Controls Update Conference, a Defense Department official discussed DoD’s review of export licenses as part of a technology transfer panel.

DoD Outlines Ways to Improve Export License Processing Times

According to the DoD official, the following are ways exporters can improve export license processing times:

Communication: early and often

  • On sensitive technologies going to sensitive countries, one should make sure that early contact is made with licensing officers
  • Don’t be afraid to call the assigned licensing officers

Complete Licensing Packages

  • Ensure license application is completely filled out and has correct information
  • Ensure all supporting documentation is completed and accurate
  • More details outlining specifics of the transaction are always welcomed; this is critical in technology transactions

Complete due diligence on all end-users

  • Review entity list, unverified list, etc.
  • Ensure all end-user certificates are completed and delivered with the application

Set realistic expectations with customers

  • Educate customers on the U.S. exports licensing process and responsibilities

DoD Reviews Twice as Many Munitions as Dual-Use Licenses, Approves Most

In calendar year 2009, the Defense Department reviewed 38,374 munitions licenses and 16,280 dual-use licenses.

Of the 38,374 munitions licenses reviewed, 88% were approved, 1% were objected to, and 11% received other action (returned without action (RWA), etc.).

Of the 16,280 dual-use licenses reviewed, 90% were approved, 8% were objected to, and 2% received other action (e.g., RWA, etc.).
