China Steel Standard, Line, and Pressure Pipe: Final Affirmative CV Determination

The International Trade Administration has made a final affirmative countervailing duty determination that countervailable subsidies are being provided to producers and exporters of certain seamless carbon and alloy steel standard, line, and pressure pipe from China.

Critical Circumstances Continue for Hengyang, “All Others”

The ITA continues to find that critical circumstances exist for Hengyang (see table below for lists of included companies), and for "all other" Chinese exporters of seamless pipe. Accordingly, suspension of liquidation took effect for entries of seamless pipe by Hengyang and “all others” with a time of entry on or after December 1, 2009 (90 days prior to the publication date of the preliminary determination).

The ITA also continues to find that critical circumstances do not exist for TPCO (see table below for lists of included companies).

CV Liquidation Resumed and No Cash Deposits/Bonds as of June 29

For this investigation, the four month period for which the CV suspension of liquidation may remain in effect before the order is issued began on March 1, 2010 (the publication date of the preliminary determination) and ended on June 28, 2010.

Therefore, the ITA has instructed CBP to discontinue the CV suspension of liquidation for CV duty purposes, and the collection of CV duty cash deposits or bonds, for all entries of subject merchandise with a time of entry on or after June 29, 2010.

(Suspension of CV liquidation continues for entries of subject merchandise with a time of entry on or after March 1, 2010 through June 28, 2010 for TPCO, and for December 1, 2009 through June 28, 2010 for Hengyang and “all others.”)

CV Liquidation to be Re-Suspended, Cash Deposits Collected, If CV Order Issued

If the International Trade Commission issues a final affirmative injury determination, the ITA will issue a CV duty order and instruct CBP to suspend liquidation of entries of subject merchandise and to require a cash deposit on all such entries equal to the revised CV duty rates listed below.

ASTM A-335 Now Excluded from Scope

Pursuant to comments received, the ITA has determined to remove ASTM A-335 from the list of covered specifications included within the scope of this investigation. ASTM A-335 is now a specification listed as excluded from the scope. The amended language for this change is as follows1:

“Specifically excluded from the scope of these investigations are: (1) all pipes meeting aerospace, hydraulic, and bearing tubing specifications; (2) all pipes meeting the chemical requirements of ASTM A-335, whether finished or unfinished; and (3) unattached couplings. Also excluded from the scope of these investigations are all mechanical, boiler, condenser and heat exchange tubing, except when such products conform to the dimensional requirements, i.e., outside diameter and wall thickness of ASTM A-53, ASTM A-106 or API 5L specifications.”
