AD Liquidation Resumed, Cash Deposits/Bonds Terminated Dec 12 - March 11
The International Trade Commission has determined that critical circumstances do not exist with respect to imports of subject merchandise from China that are subject to the ITA’s affirmative critical circumstances finding.
Therefore, the ITA will instruct U.S. Customs and Border Protection to lift suspension of liquidation and to release any bond or other security, and refund any cash deposit or bond made to secure the payment of estimated AD duties with respect to entries of the merchandise with a time of entry on or after December 12, 2009 through March 11, 2010 (the day prior to the publication date of the preliminary determination).
AD Liquidation Resumed & Cash Deposits/Bonds Terminated Sept 8-15
Now that that a negative critical circumstances determination has been made, the six month period for which the AD suspension of liquidation may remain in effect before the order is issued began on March 12, 2010 (the publication date of the preliminary determination) and ended on September 7, 2010.
As the ITC’s final affirmative injury determination was published on September 16, 2010, the ITA will instruct CBP to terminate the AD suspension of liquidation and to release all bonds and refund all AD duty cash deposits on unliquidated entries of subject merchandise from China with a time of entry on or after September 8, 2010 through September 15, 2010.
AD Suspension of Liquidation Resumes Sept 16
The AD suspension of liquidation resumes for all entries of subject merchandise from China with a time of entry on or after September 16, 2010.
AD Cash Deposit Requirements
The ITA will also instruct CBP to require, at the same time as importers would normally deposit estimated duties, AD cash deposits on entries of subject merchandise from China with a time of entry on or after September 16, 2010 at the AD duty rates below1.
