Russia Magnesium Metal: Final Results of AD Duty Admin Review

The International Trade Administration has issued the final results of its antidumping duty administrative review of magnesium metal from Russia for the period of April 1, 2008 through March 31, 2009.

1The ITA has found an AD duty rate of zero for AVISMA, therefore, no cash deposit is required; however, it remains subject to the order.

(a) For previously reviewed or investigated companies other than AVISMA, the AD duty cash deposit rate will continue to be the company-specific rate published for the most recent period;

(b) If the exporter is not a firm covered in this review, a prior review, or the original AD investigation but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and

(c) The AD duty cash deposit rate for all other manufacturers or exporters will continue to be the all-others rate established in the AD investigation, which is 21.01%.

Assessment Instructions

The ITA will issue assessment instructions to U.S. Customs and Border Protection within 15 days after September 17, 2010. The ITA will instruct CBP to apply a dumping margin of zero percent to all entries of subject merchandise during the review period that were produced and exported by AVISMA and imported by AVISMA’s U.S. affiliate.

ITA Finds No Sales by SMW, Automatic Assessment for SMW and AVISMA

The ITA has found that Solikamsk Magnesium Works (SMW) had no sales to the U.S. during the period of review. However, pursuant to its “automatic assessment” clarification of May 2003, the ITA finds that it is more consistent not to rescind the review in part in these circumstances but rather to complete the review with respect to SMW and issue appropriate instructions to CBP based on the final results of the review.

Therefore, for entries of subject merchandise during the review period produced by AVISMA or SMW for which AVISMA or SMW did not know their merchandise was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries of merchandise produced by AVISMA or SMW at the all-others rate if there is no rate for the intermediate company(ies) involved in the transaction.
