Thailand Frozen Warmwater Shrimp: Final Results of AD Admin Review
The International Trade Administration has issued the final results of its antidumping duty administrative review of certain frozen warmwater shrimp from Thailand for the period of February 1, 2008 through January 31, 20091.

(a) For previously reviewed or investigated companies not participating in this review, the AD duty cash deposit rate will continue to be the company-specific rate published for the most recent period;
(b) If the exporter is not a firm covered in this review, a prior review, or the original AD investigation, but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and

Assessment Instructions
The ITA will issue assessment instructions to U.S. Customs and Border Protection within 15 days after September 9, 2010. The ITA has calculated importer-specific ad valorem duty assessment rates for the subject merchandise.
For the companies which were not selected for individual review, the ITA has calculated an assessment rate based on the weighted average of the AD duty cash deposit rates calculated for the companies selected for individual review.
The ITA adds that for entries of subject merchandise during the review period produced by companies included in these final results of review for which the reviewed companies did not know that the merchandise they sold to the intermediary (e.g., a reseller, trading company, or exporter) was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the all-others rate if there is no rate for the intermediary involved in the transaction. 1In its Federal Register notice, the ITA correctly listed an AD duty rate of 4.39% for the Rubicon Group (which includes the companies listed below) for the review period. However, effective January 16, 2009, there is no longer a cash deposit requirement for Rubicon Group, as well as another company, Thai I--Mei Frozen Foods Co., Ltd., in accordance with the the ITA’s implementation of the Section 129 Determination in January 2009.
The ITA states that the Rubicon Group includes Andaman Seafood Co., Ltd., Chanthaburi Frozen Food Co., Ltd., Chanthaburi Seafoods Co., Ltd.; Intersia Foods Co., Ltd. (formerly Y2K Frozen Foods Co., Ltd.); Phatthana Seafood Co., Ltd., S.C.C.; Frozen Seafood Co., Ltd., Thailand Fishery Cold; Storage Public Co., Ltd.; Thai International Seafoods Co., Ltd.; and Wales & Co. Universe Limited.
(This footnote was added on September 21, 2010 to clarify that no AD duty cash deposit is currently required for the Rubicon Group, and the Rubicon Group has been removed from ITT's table of companies for which AD duty cash deposits are required on or after September 9, 2010.)
