The ITA initiated this review to determine whether Phuong Nam Foodstuff Corp. is the successor-in-interest to Phuong Nam Co., Ltd. for purposes of determining AD duty liability.

Phuong Nam Foodstuff is Successor-in-Interest, Receives 4.27% AD Rate

For the reasons stated in the preliminary results and because the ITA received no comments to the contrary, it continues to find that Phuong Nam Foodstuff Corp. is the successor-in-interest to Phuong Nam Co., Ltd.

Consequently, the ITA will instruct U.S. Customs and Border Protection to apply the AD duty cash deposit rate in effect for Phuong Nam Co., Ltd. of 4.27% to all entries of the subject merchandise from Phuong Nam Foodstuff Corp. with a time of entry on or after August 16, 2010.

(See ITA notice for more information, including the scope of the order, etc.
